To put it in more legal savvy wording... Em is protected by something similar to "Copyleft" centric method.
Shem, a variation of Em, was made with VSPAR's permission.
The main plot, the character, and so on are the property of VSPAR
However, so long as people know that VSPAR provided the source material, it's allowed.
If I'm reading this right, VSPAR would absolutely love to see more Em variations, fanart, and enthusiasts.
